These Terms & Conditions (“Terms”) govern the supply of products by Aesthetic 26 Wholesale Ltd(“Aesthetic 26”, “we”, “us”, “our”) to its trade customers (“you”, “Customer”) through aesthetic26.ie. By creating an account, placing an order or otherwise transacting with us you confirm that you have read, understood and accepted these Terms. If you do not accept these Terms you must not use the website or place an order.

1.About Aesthetic 26 Wholesale
Aesthetic 26 Wholesale Ltd is an Irish wholesale supplier of professional aesthetic products, clinic consumables and related goods, supplying registered Irish clinics and licensed aesthetic practitioners on a strictly business-to-business (“B2B”) basis.

We are notified to the Health Products Regulatory Authority (HPRA) where products fall within HPRA scope. Cosmetic products in our range that fall within scope of EU Regulation 1223/2009 are notified on the Cosmetic Products Notification Portal (CPNP) by the relevant Responsible Person.
2.Trade-only sales — eligibility
The Aesthetic 26 Wholesale website and product range is available exclusively to verified trade customers. By registering an account or placing an order you confirm and warrant that:
- You are a registered Irish clinic, body or individual licensed and qualified to practice the relevant aesthetic procedure;
- You hold current, valid professional indemnity insurance covering your aesthetic practice;
- You are purchasing in the course of business and not as a consumer within the meaning of the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013;
- You will use products only within your training, registration and scope of practice;
- You are at least 18 years of age;
- The information you supply on registration and at checkout (including business name, address, VAT number, certification documents and indemnity status) is accurate, current and complete.
We may at our discretion request additional verification documents at any time (including but not limited to professional qualifications, indemnity certificates, medical registration numbers, business proof of trade and government-issued identification). We reserve the right to refuse, suspend or terminate any account where verification is incomplete, expired, withdrawn or where we reasonably suspect misrepresentation.
3.Account registration and security
To purchase from us you must create a trade account. You agree to:
- Provide accurate, complete and current information during registration;
- Maintain the confidentiality of your account password;
- Promptly notify us of any unauthorised access or use of your account;
- Keep your professional verification documents (insurance, certificates) current and uploaded; and
- Notify us promptly of any change to your professional status, scope of practice, business address or contact details.
You are responsible for all activity that occurs under your account. We will not be liable for any loss or damage arising from your failure to comply with this Section. We may suspend or close accounts where these obligations are not met.
4.Orders and formation of contract
All orders placed through aesthetic26.ie constitute an offer by you to purchase products subject to these Terms. A binding contract of sale is only formed when we issue an order confirmation email (and, in the case of card-paid orders, after Stripe has confirmed payment). We may decline any order at our discretion, including where:
- Verification of your trade status is incomplete or has lapsed;
- A product is unavailable, mispriced or has been withdrawn;
- We reasonably suspect fraud, misrepresentation or non-permitted use; or
- Payment fails or is declined.
Where an order is declined any payment taken will be refunded in full to the original payment method.
5.Pricing, VAT and tax
All prices on the website are quoted in Euro (€) exclusive of VAT unless expressly stated otherwise. Irish VAT at the prevailing rate (currently 23%) is added at checkout where applicable. Where you provide a valid EU VAT number that we verify against the EU VIES registry, VAT may be zero-rated in accordance with applicable EU intra-community supply rules; you remain responsible for reporting and accounting for VAT in your jurisdiction.
Promotional pricing (including launch discounts) and discount codes are subject to the following rule: discounts and promotional sale prices do not combine. Where a customer applies a discount code to a product also on launch / sale pricing, the larger of the two discounts is applied automatically — you will never pay more than the best available price, and the two will not stack. Single-use discount codes are tied to the redeeming email address and may not be reused.
We reserve the right to correct manifest pricing errors at any time before dispatch. Where a price error is identified after order confirmation we will contact you to confirm whether to proceed at the corrected price or cancel the order for full refund.
6.Payments
We accept payment by debit or credit card via Stripe Payments Europe Ltd. (Stripe). Click & Collect orders may also be settled in cash on collection at our Limerick collection point, at our discretion and subject to product availability.
- We do not see, store or process your card details directly. All card payments are processed by Stripe under their own terms;
- Where payment fails, your order will be cancelled and stock will not be reserved;
- Refunds (where applicable) are made to the original payment method;
- Cash payment for Click & Collect orders is due in full at the point of collection. Failure to collect within the stated holding period (default 2 business days, extendable on request) entitles us to cancel and re-allocate stock.
7.Delivery, risk and title
We dispatch via DPD next-day across Ireland. Standard delivery cost is €10 ex VAT; free for orders over €400 ex VAT to a single Irish address. Orders placed before 12:00 (noon) on a business day dispatch the same day for next-business-day delivery (subject to courier service levels). Orders placed after the cut-off, on weekends or on Irish public holidays dispatch on the next business day.
Delivery times are estimates only. We will not be liable for delays caused by the courier, weather, customs (where relevant), industrial action, force majeure or any other cause outside our reasonable control.
Risk in the goods passes to you on delivery to the address you nominate (or on collection, for Click & Collect orders). Title in the goods passes to you only on full payment. Until payment is received, we retain title and may, on reasonable notice, recover the goods.
On receipt please follow the manufacturer’s storage instructions printed on the product or supplied with it. Failure to follow storage instructions may invalidate the warranty.
8.Cancellation, returns and faulty goods
As a B2B trade transaction, the consumer-style 14-day cooling-off period does not apply to your purchases from us. However, we will accept returns or issue refunds in any of the following circumstances:
- The product is faulty, damaged in transit, or does not match the description on the website;
- We have mis-shipped the order;
- The manufacturer’s storage requirements have verifiably been breached in transit;
- The product is subject to a manufacturer or regulatory recall.
To raise a return, contact info@aesthetic26.ie within 7 days of delivery with photographs of the issue, the order reference and your account number. We will arrange collection or replacement on a case-by-case basis. Returned product must be unopened, unused and in the original packaging unless agreed otherwise.
Refunds, where due, are processed within 14 days of the goods being received back at our warehouse (or, in the case of a clear fault evidenced by photograph, on agreement).
9.Recalls and safety notices
We operate a batch- and lot-traceable inventory system. If a product, batch or lot in our range is the subject of a manufacturer recall, regulatory recall or safety notice, we will:
- Identify all customers who purchased from the affected batch or lot;
- Send a high-priority recall email and in-account notification to those customers;
- Track read receipts and follow up where acknowledgement has not been received;
- Share relevant information with the HPRA, the European Medicines Agency or any other competent regulatory authority where required by law.
You agree to act on any recall or safety notice promptly, including ceasing further use or sale of the affected product, quarantining stock, and following the instructions issued. Recall communications are treated as essential safety communications and will be sent regardless of marketing opt-in preferences.
10.Acceptable use and product restrictions
You must not, in connection with our products or the website:
- Use any product outside its labelled indication, the manufacturer’s instructions, or your professional training and scope of practice;
- Re-sell any product to consumers or to any unverified party, or hold yourself out as the manufacturer;
- Tamper with, relabel, repackage or counterfeit any product;
- Use the website in any unlawful way, attempt to gain unauthorised access, transmit malware, or scrape data;
- Use professional verification documents that are not yours or are not current.
Breach of this Section is a material breach of these Terms and entitles us to suspend or terminate your account immediately, withhold orders, reverse payments where lawful and report to relevant authorities.
11.Product information, training and clinical advice
Product descriptions, indications, sizes and images on the website are provided in good faith from manufacturer documentation. They are not a substitute for proper clinical training, manufacturer instructions or product dossiers, all of which take precedence in the event of any conflict.
We do not provide clinical training or clinical advice. Where appropriate, we may signpost to partnered academies (see Academies & Kits) but you remain responsible for selecting and completing training appropriate to your practice. Where a product carries a regulatory mark (CE marking, CPNP notification), the scope of practice is defined by that regulatory framework and your professional registration — see our CE & CPNP guidance.
12.Warranties and disclaimers
Subject to applicable Irish law, we warrant that the products we supply:
- Match the description on the website at the time of order;
- Are supplied directly from the manufacturer or an authorised EU distributor;
- Carry the regulatory documentation appropriate to their classification, available on request.
To the maximum extent permitted by Irish law, all other warranties — express or implied, statutory or otherwise — are disclaimed, including any implied warranty of fitness for a particular purpose where the product is being used outside its labelled indication or outside the practitioner’s scope of practice. Nothing in these Terms limits any rights you have that cannot be lawfully excluded.
13.Limitation of liability and indemnity
Nothing in these Terms limits or excludes our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any other liability that cannot be limited or excluded under Irish law.
Subject to the above, our total aggregate liability arising under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the liability. We shall not in any circumstances be liable for indirect, consequential, incidental, special or punitive losses, loss of revenue, loss of profit, loss of goodwill, loss of business opportunity or loss of data.
You indemnify and hold harmless Aesthetic 26 against all claims, losses, damages, fines, judgments, settlements, costs and expenses (including reasonable legal fees) arising out of or in connection with (a) your breach of these Terms, (b) your use of any product outside its labelled indication or your scope of practice, (c) any misrepresentation you make in connection with your account or order, or (d) any third party claim arising from your treatment of a patient with a product supplied by us.
14.Data protection — GDPR summary
We process personal data in compliance with Regulation (EU) 2016/679 (GDPR) and the Irish Data Protection Act 2018. In summary:
- Data controller: Aesthetic 26 Wholesale Ltd, contact info@aesthetic26.ie;
- What we collect: account identity, business details, professional verification documents, order history (including batch / lot data), communications, marketing preferences and limited technical data;
- Why we process it: performance of your contract with us (orders, account, delivery), legal obligation (VAT, traceability, regulatory), legitimate interests (fraud prevention, recalls) and consent (marketing only);
- Who we share with: Supabase (database, EU hosted), Stripe (payments), Resend (transactional email), Vercel (web hosting), DPD (delivery), HPRA / Data Protection Commission and other regulators only where required by law;
- How long we keep it: typically 6 years for accounting records, up to 10 years for medical device traceability, while your account is active otherwise;
- Your rights: access, rectification, erasure, restriction, portability, objection and the right to lodge a complaint with the Data Protection Commission (dataprotection.ie).

15.Intellectual property
All content on aesthetic26.ie — including text, images, logos, branding, product descriptions, layout and code — is owned by or licensed to Aesthetic 26 Wholesale Ltd and protected by applicable copyright, trademark and other intellectual property laws. You may not copy, reproduce, distribute or create derivative works without our prior written consent.
Manufacturer brand names and product images appear with the relevant manufacturer’s permission or in accordance with applicable fair-use principles for resale purposes.
16.Force majeure
Neither party will be liable for failure to perform any obligation under these Terms (other than payment obligations) to the extent that performance is prevented or delayed by an event beyond its reasonable control, including but not limited to acts of God, war, civil unrest, governmental action, regulatory withdrawal, industrial dispute, failure of utilities or telecommunications, courier failure, supplier failure, pandemic, fire, flood or extreme weather.
17.Termination
You may close your account at any time by contacting us. We may suspend or terminate your account immediately on written notice if you breach these Terms, engage in unlawful conduct, fail verification, or where required to do so by law. Termination does not affect rights and obligations accrued before termination.
18.Changes to these Terms
We may amend these Terms from time to time. The version published on aesthetic26.ie at the time you place an order applies to that order. Material changes will be communicated to active account holders by email and/or in-account notification. Continued use of your account after a notified change constitutes acceptance.
19.Severability, waiver and assignment
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force. No waiver by us of any breach is a waiver of any subsequent breach. We may assign or sub-contract our rights and obligations on written notice; you may not assign your rights without our written consent.
20.Governing law and jurisdiction
These Terms and any contract formed under them are governed by the laws of Ireland. The Irish courts have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, except that we may bring proceedings in any other jurisdiction where you are located if necessary to protect our intellectual property or recover sums due.
